Opt Out Procedure

HHSD Opt-Out Procedure

  • Families of ELs who qualify for ELD services receive a "Notice of Program Placement" letter at the start of the year describing program type, and contact information for opting-out  

  • Schools receiving an opt-out request must schedule a meeting with the parent/guardian 

    • Meetings should include the following people:  

      • Elementary Level: Principal or assistant principal, ESL teacher, parent/guardian 

      • Secondary Level: Administrator, Counselor, ESL teacher, parent/guardian? 

    • Translation services should be provided using TransPerfect 

    • Parents are to be provided with the following information in the opt-out meeting 

      • WIDA ACCESS results for their student 

      • "District Legal Obligations" document 

      • Explanation of Consequences 

      • "ELDP Parental Waiver" document 

    • The following forms must be signed and retained for parents who elect opting-out 

      • "Explanation of Consequences for Refusing English Learner Service"  

      • "District Legal Obligations" document 

      • "ELDP Parental Waiver" document 

    • Copies of the opt-out forms must be forwarded to the Curriculum Office and placed in the student cumulative folder 

  • Annual WIDA ACCESS testing is still required for students who opt out of ELD services. 

  • Reinstatement can occur at any time following the decision to opt out. The opt-out reinstatement form is included here.
